Preamble

What is Preamble? Preamble is like a preface of the book providing an insight into the values on which Indian Constitution is based upon. Preamble is the introductory part of the constitution which provides a brief about the various pillars on which Constitution of India stands. Preamble of India states that India is a Sovereign, Socialist, Secular, Democratic, Republic which aims to provide Justice, Liberty, Equality and Fraternity to all its citizens. Thus Preamble of Indian Constitution list down various principles on which this living document is based upon.


Preamble of India

1) What is Preamble?

Preamble has the essence or summary of the constitution. It is like the preface or introductory part of the constitution

Preamble of India reads as :


“We, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST  SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens:
JUSTICE, Social, Economic and Political;
LIBERTY of thought, expression, belief, faith and worship;
EQUALITY of status and of opportunity; and to promote among them all;
FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;
IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949, do HEREBY
ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION”.

The basic features of the Preamble are :

Preamble of Indian Constitution is based on the "Objective Resolution" which was moved by Jawahar Lal Nehru on 13th Dec, 1946 in the constituent assembly and was adopted by the constituent assembly on 22nd Jan, 1947.


ii) How many times has Preamble been amended ? 

Preamble of India has been amended only once through 42nd Constitutional Amendment Act, 1976 (also called as Mini Constitution) which added three more words:  Socialist, Secular, Integrity.


iii) Is Preamble a part of Indian Constitution ?

Yes
, Preamble is a part of the Indian Constitution.


iv) Preamble is neither a source of power to legislature nor prohibits its power.


v) Is preamble justiciable in nature? Can its provisions be enforced by law ?

No, Preamble is non-justiciable in nature, hence its provisions cannot be enforced by the law.

There are four important components or ingredients of the Preamble :

a) Source of authority: 

Constitution derives it's authority or power from the people of India, which is explicitly stated in the Preamble as  We, THE PEOPLE OF INDIA  


b) What is the Nature of Indian State ?

India is a Sovereign, Socialist, Secular Democratic and Republican country (S3DR) which is mentioned in Preamble of India as :
[constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC]


c) What are the Objectives of Indian Constitution ? 

The objectives of the Indian constitution are stated in the preamble as justice, liberty, equality and fraternity.

The date on which Constitution of India was adopted by the constituent assemble is mentioned in the Preamble as November 26, 1949.
